Terms Of Service

Welcome to use _app_name - Voice Chat Room & Game (hereinafter referred to as the "Platform" or "APP"). This agreement is jointly signed by the _app_name team (owner and operator), the client, and you ("you" or "user"), and has zero tolerance for any inappropriate content or malicious users. By using _app_name, you agree to these terms. If you do not agree to any of the terms, you may not use the service.

1. _app_name Services

These terms of service apply to all users of _app_name services.

2. Usage Agreement

(1) Compliance with Terms of Use

Your access to and use of our services are subject to these terms of use, your agreement to the Platform's privacy policy, and any applicable laws, rules, and regulations governing our services.

(2) Age Requirements

Although we do provide content suitable for children, children should not use our services without parental or guardian supervision and approval. If you are under the age of 12 (or the legal age of majority in your state, region, or country of residence), you may not register for or use our services or provide us with your personal data.

(3) Binding Agreement

By registering for our services or accessing any content, you enter into a binding agreement with us and confirm that any information you provide to us is always true, accurate, and complete, and that you are:

i. At least 18 years of age (or the legal age of majority in your state, region, or country of residence), you agree and consent to be bound by these TOU and other agreements;

ii. At least 12 years of age but under 18 years of age (or under the legal age of majority in your state, region, or country of residence), your parent or guardian has consented to your use of our services and access to any content. Such consent shall also include consent on your behalf to these terms of use and other agreements (including any modifications you make to our account).

(4) Account Operation and Use

You are responsible for all use of your account, including use by other members of your household or acquaintances. By allowing others to access your account or create profiles within your account, you agree to be responsible for ensuring their compliance with these terms of use and other agreements, and you agree to be responsible for their activities when using our services.

(5) Accurate Data

You confirm and warrant that all data and information you provide to us are accurate in all respects, and you agree to promptly update your registration data as necessary to ensure that it remains accurate at all times.

(6) Software Updates

By downloading, installing, or using our services, you agree to receive automatic software updates (if applicable).

(7) Malware

You may not knowingly or recklessly introduce viruses or other harmful components, or otherwise tamper with, impair, or damage our services or connected networks, or interfere with any individual or entity's use or enjoyment of our services.

3. User Content

3.1. Definition

The term "User Content" as used in these terms refers to any content uploaded, posted, or transmitted (collectively, "posted") by users to the service, including but not limited to any textual content. Please note that "User Content" here does not include content provided by the company to users through the service (hereinafter referred to as "Company Content"), which is defined as all content provided by the company to users through the service, including but not limited to any text and interactive features.

3.2. No User Content Screening

Users may post User Content to the service or transmit it through the service. Although we strive to ensure that all User Content complies with our community guidelines (which you can view in our application), we do not pre-screen any User Content submitted or publicly posted by users. However, we reserve the right to remove, prohibit, or temporarily block any User Content that: (i) we believe violates these terms, our community guidelines, or any applicable law, or (ii) is in response to complaints from other users, whether or not notified. Since we cannot review all User Content, we cannot guarantee its accuracy, completeness, authenticity, appropriateness, or quality. Therefore, any use of or reliance on any User Content is at your own risk.

3.3. Ownership of User Content

License: You are the owner and retain the rights to the User Content you post and display on and through the service. However, you grant us a worldwide, transferable, sublicensable, royalty-free license to reproduce, distribute, publicly display, transmit, and make derivative works available to the public in any media and formats now known or later developed, and otherwise develop and use all User Content you post or make available through the service for (i) advertising, marketing, and promoting the company and services; (ii) displaying and sharing your User Content with other users of the service; (iii) providing the service in accordance with these terms. If you terminate your account after posting or delete any of your User Content from the service, your User Content license will terminate permanently and irrevocably. Additionally, you grant us and our affiliates and business partners an unlimited, worldwide, royalty-free license and the right to use your username and image to identify you as the source of any User Content. Please note that you may not post any User Content on or through the service that you consider confidential or proprietary. Any User Content you post or make available through the service or otherwise send to us will be considered non-confidential and non-proprietary and will be processed and used by us, and the company may use such content in accordance with these terms without further notice and without any liability. It should be noted that the authorization mentioned in this paragraph includes, but is not limited to, the right to reproduce your User Content on a royalty-free basis, meaning that you grant us the right to use your User Content without paying royalties to you or any third party involved in creating the User Content.

3.4. User Content Restrictions

By posting User Content to the service, you must comply with the following restrictions:

(1) You must be the owner of the User Content you post or make available through the service, or have the right to grant the license set forth in these terms;

(2) The User Content you post or make available through the service must not infringe on anyone's privacy rights, publicity rights, copyrights, contractual rights, intellectual property rights, or any other rights;

(3) Posting your User Content on the service should not require us to obtain any further licenses from or pay any royalties, fees, compensation, or other amounts to any third party, or provide any attribution to any third party;

(4) Posting your User Content on the service must not result in a breach of any agreement between you and a third party.

3.5. Prohibited Content

(1) Pornographic Content

Includes pornographic or erotic content (involving icons, titles, descriptions, etc.). We have a zero-tolerance policy for child sexual abuse images. If we discover any User Content containing child sexual abuse images, we will immediately report it to the relevant authorities and delete the submitting user's account;

(2) Violent and Bullying Content

User Content must not contain materials that threaten, harass, or bully other users or third parties, including depictions of violence, gratuitous harm, or other aspects directed at any person or property, or incitement to violence, including suicide;

(3) Hate Speech

User Content must not promote prejudice, discrimination, hatred, intolerance, or racism based on race or ethnicity, religion, disability, gender, age, nationality, veteran status, sexual orientation, or gender identity, or target any individual or group;

(4) Sensitive Event Content

User Content that may be considered capitalizing on or lacking reasonable sensitivity to natural disasters, atrocities, conflicts, deaths, or other tragic events is not permitted;

(5) Illegal Activity Content

Using the service for any illegal or unlawful purpose, including but not limited to stalking and sexual exploitation of any user; and content that infringes on intellectual property rights, i.e., User Content that infringes on any third-party rights, including copyright, trademark, privacy, and publicity rights, etc.

Term and Termination of Terms. The validity period of these terms. The validity period of these terms begins on the date you first use the service and continues until you or we terminate these terms.

4. _app_name Access

Subject to your compliance with these Terms of Service, _app_name grants you a license to use the Service, provided that:

(1) Your use of the Service is limited to personal, non-commercial purposes;

(2) You shall not copy, transfer, provide access to, reproduce or distribute any part of the Service without prior written authorization from _app_name;

(3) You shall not attempt to reverse engineer, modify or alter any part of the Service;

(4) You will comply with other terms and conditions of these Terms of Service.

5. Sensitive Content Reporting

(1) Zero tolerance for inappropriate content or malicious users;

(2) Review and identification of pornographic content. Any user posting pornographic content in profiles, backgrounds or chat rooms will be blocked within 24 hours.

(3) Administrators reserve the right to monitor and investigate. Depending on the severity of behavior, user accounts may be banned.

6. User Status Submissions

(1) The _app_name Service allows submission of status texts and other communications submitted by you and other users ("User Status Submissions"), as well as hosting, sharing and/or publishing these User Status Submissions. As described below, you retain all rights to your User Status Submissions. You understand that regardless of whether these User Status Submissions are published, _app_name does not guarantee confidentiality of any submissions.

(2) You will be solely responsible for your own User Status Submissions and the consequences of posting or publishing them. Since _app_name only serves as a repository for data, user-submitted statuses do not necessarily represent the views or opinions of _app_name, and _app_name makes no warranties regarding the validity, accuracy or legal status of any status. Regarding User Status Submissions, you represent, warrant and/or agree that:

i. You own or have obtained all necessary licenses, rights, consents and permissions to use and authorize _app_name to use all patents, trademarks, trade secrets, copyrights or other proprietary rights to include and use all your User Status Submissions in accordance with the Service and these Terms of Service;

ii. You have obtained written consent, release and/or permission from each identifiable individual to include and use their name or likeness in the Service and these Terms of Service. To be clear: you retain all rights to your User Status Submissions, but you must first possess the relevant rights. However, by submitting User Status Submissions to _app_name, you hereby grant _app_name a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use, reproduce, distribute, prepare derivative works of, display and perform User Status Submissions in connection with the _app_name Service and _app_name's (and its successors') business, including without limitation for promoting and redistributing part or all of the _app_name Service (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each subscriber of the _app_name Service a non-exclusive license to access your User Status Submissions through the Service, via email and mobile devices, and to display portions of your User Status Submissions according to Service functionality and these Terms of Service. The foregoing license terminates when you remove or delete your User Status Submissions from the _app_name Service.

(3) In submitting User Status Submissions, you further agree not to:

i. Submit material protected by copyright, trade secret or other proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from the rightful owner to post the material and to grant _app_name all license rights granted herein;

ii. Publish falsehoods or misrepresentations that could damage _app_name or any third party;

iii. Submit material that is unlawful, obscene, defamatory, libelous, threatening, harassing, hateful, racially or ethnically offensive, or that encourages conduct that would constitute a criminal offense, give rise to civil liability, violate any law or is otherwise inappropriate;

iv. Post advertisements or solicitations of business;

v. Impersonate another person;

vi. Send or store material containing software viruses, worms, Trojan horses or other harmful computer code, files, scripts, agents or programs;

vii. Interfere with or disrupt the integrity or performance of the Service or its data;

viii. Attempt to gain unauthorized access to the Service or its related systems or networks.

(4) Adult content must be labeled as such. _app_name does not endorse any User Status Submissions or any opinion, recommendation or advice expressed therein, and _app_name expressly disclaims any and all liability in connection with User Status Submissions. _app_name does not permit copyright infringing activities or infringement of intellectual property rights through its Service, and will remove all infringing content and User Status Submissions upon receiving proper notice. _app_name reserves the right to remove content and User Status Submissions without prior notice. _app_name may also terminate a user's access to the Service if the user is determined to be a repeat infringer, or for any reason or no reason (including being objectionable). A repeat infringer is a user who has been notified of infringing activity more than once and/or whose User Status Submissions have been removed from the site more than twice. An objectionable person is one who is determined by _app_name's authorized employees, agents, sub-agents or super-agents (with or without malice) to be objectionable. _app_name also reserves the right to decide whether content or User Status Submissions are appropriate and comply with these Terms of Service, beyond copyright infringement and intellectual property law violations, such as but not limited to overly lengthy or limited-interest content. _app_name may remove such User Status Submissions and/or terminate a user's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at _app_name's sole discretion.

(5) You understand that when using the _app_name Service, you will be exposed to User Status Submissions from various sources, and _app_name is not responsible for the accuracy, usefulness, safety or intellectual property rights of such User Status Submissions, which are beyond _app_name's scope of responsibility. You further understand and acknowledge that you may be exposed to User Status Submissions that are inaccurate, offensive, indecent or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you may have against _app_name with respect thereto, and agree to indemnify and hold _app_name, its owners/operators, affiliates and/or licensors harmless to the fullest extent permitted by law regarding all matters related to your use of the site.

(6) _app_name permits you to link to materials on the Service for personal, non-commercial purposes only. Commercial versions may be available under separate license and terms. _app_name reserves the right to discontinue any aspect of the _app_name Service at any time. You agree that your use of the _app_name Service shall be at your sole risk. To the fullest extent permitted by law, _app_name and its officers, directors, employees and agents disclaim all warranties, express or implied, in connection with the Service and your use thereof. _app_name makes no warranties or representations about the accuracy or completeness of the Service's content and shall not be liable for any:

i. Errors, mistakes or inaccuracies of content;

ii. Personal injury or property damage of any nature resulting from your access to and use of our Service;

iii. Any unauthorized access to or use of our secure servers and/or any personal information and/or financial information stored therein;

iv. Any interruption or cessation of transmission to or from our Service;

v. Any bugs, viruses, Trojan horses or the like that may be transmitted to or through our Service by any third party;

vi. Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available via the _app_name Service.

_app_name does not warrant, endorse, guarantee or assume responsibility for any product or service advertised or offered by a third party through the _app_name Service or any hyperlinked website or featured in any User Status Submission or other advertisement, and _app_name will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services. As with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate. Again, for entertainment purposes only.

7. Limitation of Liability

In no event shall _app_name, its officers, directors, employees or agents be liable for any direct, indirect, incidental, special, punitive or consequential damages whatsoever resulting from:

(1) Errors, mistakes or inaccuracies of content;

(2) Personal injury or property damage of any nature resulting from your access to and use of our Service;

(3) Any unauthorized access to or use of our secure servers and/or any personal information and/or financial information stored therein;

(4) Any interruption or cessation of transmission to or from our Service;

(5) Any bugs, viruses, Trojan horses or the like that may be transmitted to or through our Service by any third party;

(6) Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available via the _app_name client and content publishing, email transmission, transmission or otherwise. Whether based on warranty, contract, tort or any other legal theory, and whether or not the company is advised of the possibility of such damages.

The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. You specifically acknowledge that _app_name shall not be liable for user submissions or the defamatory, offensive or illegal conduct of any third party, and that the risk of harm or damage from the foregoing rests entirely with you. You agree that you will not use the product while operating a motor vehicle, for time-critical or emergency services or events, or for any operations that may lead to injury, death or economic loss. _app_name does not represent that the _app_name Service is appropriate or available for use in all locations. Those who access _app_name from other jurisdictions or use the _app_name Service do so on their own initiative and are responsible for compliance with local laws.

8. Termination of Service

You may terminate all other services by deleting your account and the application from the mobile device where the app is installed. If you wish to remove any User Content from the service, you may use the app's permission features to do so, but removing or deleting such User Content will not terminate these Terms. If you violate these Terms or any terms of our application, or infringe upon the rights of any third-party copyright owner, we reserve the right to restrict, suspend, or terminate these Terms and your access to all or any part of the service at any time without prior notice or liability. We will make reasonable efforts to notify you of such termination via the email address associated with your account or when you next attempt to access your account, depending on the circumstances, but this may not always be possible.
